Legal Philosophy is a course base on a particular philosophical theory, or which surveys some central issues of research on law theory and human practice of legal system from a definite stand of philosophy, such as, the essence of law, the feature of law, the function of law, the implementation of law, the explanation of law, the relationship between law and politics, the relationship between law and morality, etc., and studies the inherent regularity of evolution of law, to reflect the theory of philosophy as its beginning. Therefore, Legal Philosophy is an interdisciplinary roaming between philosophy and law.
This course will be hold under a teaching model of combining teacher’s lecture with class discussion. Special topics involved will include:
Research subjects and the subject position of Legal Philosophy;
The historical development and main schools of western Legal Philosophy;
Comparison of main modern law systems;
The essence and function of law;
The relationship between law and other social norms;
Philosophical issues in the implementation and explanation of law;
Rule of men and rule of law and the foundation of a legal state.
